Headnote : Kopnota

The State's obligation to protect citizens and the corresponding trust that the public is entitled to place in the police service suggest a normative basis for holding the State delictually liable for the criminal acts of police officers, B provided that a sufficiently close link is established between the misconduct and the perpetrator's employment as police officer. State liability must ultimately depend on the cumulative weight of the factors pointing to the required connection, and not on omission/commission or on-duty/off-duty distinctions. The State would accordingly be vicariously liable where an C off-duty police officer had raped a young girl whom he had offered a lift in a police vehicle, the use of which had been instrumental in the commission of the rape and which was pivotal in providing the required connection between the crime and his employment.
