Die vraag of 'n beskuldigde wat hom op noodweer beroep regmatiglik gehandel het al dan nie moet volgens objektiewe standaarde beoordeel word. By so 'n beoordeling moet die fiktiewe normale mens in die posisie van die betrokke beskuldigde geplaas word, onderhewig aan al die uitwendige omstandighede waaraan hy ten tye van die geweldpleging blootgestel was.

Die appellante is skuldig bevind aan gewone aanranding. Uit die getuienis het dit geblyk dat die klaer en sy broer die appellante met lewensgevaarlike wapens aangeval en agtervolg het ten spyte van die feit dat hulle steeds die wyk geneem het tot naby hul wonings. Die appellante het bloekomboomtakke gegryp en die klaer en sy broer daarmee verweer. Deur vir klaer uiteindelik naby sy eie huis plat te slaan het hulle sy uiters gevaarlike veglustigheid beteuel en die gevaar wat sy wapens vir hulle ingehou het effektief uit die weg geruim. In hoër beroep,

Beslis, dat in die omstandighede die appellante geregtig was om die klaer ernstig te beseer: hulle kon hulle op noodweer beroep.

The question whether an accused, who relies on self-defence, acted lawfully or not must be judged according to objective standards. In such an adjudication the fictional normal person must be placed in the position of the accused concerned subject to all the external circumstances to which the accused at the time of the commission of the violence was exposed.

The appellants had been convicted of common assault. From the evidence it appeared that the complainant and his brother had attacked them with dangerous weapons and had pursued the appellants despite the fact that they had already withdrawn

to close to their own homes. They took some eucalyptus branches to defend themselves. By ultimately felling the complainant near his own house the appellants had curbed his dangerous fighting lust and had effectively removed the danger which his weapons held for them. In an appeal,

Held, that in the circumstances the appellants were entitled to have seriously injured the complainant: they were entitled to invoke self-defence.
