Die beskuldigde in hierdie saak is deur die streekhof skuldig bevind aan verkragting. Omdat die klaagster, volgens die getuienis van haar moeder, tydens die voorval op 'n maand na nege jaar oud was, is die bepalings van art 51(1) saamgelees met Deel 1 van Bylae 2 van die Strafregwysigingswet 105 van 1997 ter sprake. Daardie Wet bepaal onder andere dat 'n persoon wat skuldig bevind word aan die verkragting van 'n meisie onder die D ouderdom van 16 jaar tot lewenslange gevangenisstraf gevonnis moet word, tensy daar wesenlike en dwingende omstandighede bestaan wat die oplegging van 'n mindere vonnis regverdig. Omdat die streekhof nie jurisdiksie het om 'n vonnis van lewenslange gevangenisstraf op te lê nie het die streeklanddros die saak vir vonnisoplegging na hierdie Hof E verwys soos voorsien deur art 52 van voormelde Wet. Ek aanvaar dat hierdie prosedure geoorloof is. Vergelyk die ongerapporteerde Volbankuitspraak van die Transvaalse Provinsiale Afdeling in S v Mdjatiece SH 376/98 gedateer 30 September 1998 asook S v Ibrahim 1999 (1) SACR 106 (C) asook die kritiek daarop in S v Mofokeng 1999 (1) SACR 502 (W). Ek is nie gebonde aan enige van gemelde uitsprake nie, maar dit kom my voor asof F die benadering in eersgemelde twee sake die mees sinvolle oplossing vir die probleem bied alhoewel daar veel te sê is vir die houding geopper deur Stegmann R in laasgemelde saak. Ek is dus voornemens om te aanvaar dat hierdie Hof jurisdiksie het om die beskuldigde te vonnis. C

G Die feite van die saak is betreklik eenvoudig. Daardie feite blyk uit die gesertifiseerde oorkonde van die verrigtinge in die streekhof wat aan my voorgelê was en wat ek die geleentheid gehad het om mee vertroud te raak. Die klaagster het die dag van die voorval saam met maats buite haar moeder se huis gespeel toe die beskuldigde, wat die vader is van H die man wat met die klaagster se moeder as man en vrou saamleef, haar die huis ingeroep het. Die beskuldigde het haar damesbroekie uitgetrek, haar mond toegedruk en haar verkrag. Dit is onderbreek toe iemand, wat later 'n Staatsgetuie was, die vertrek binnegekom het. 'n Latere ondersoek deur die distriksgeneesheer het aangedui dat daar geringe beserings, I naamlik twee klein skeurtjies in die slymvlies van die lipvlies in die vagina was.
