Die aard van die oortredings waarvan die beskuldigdes aangekla word, en die algemene agtergrond van die saak blyk uit die uitspraak wat ek gelewer het in verband met die aansoek om die ontslag van die B beskuldigdes wat gedoen is met die afsluiting van die Staat se saak.

[Die Edelagbare Regter het die getuienis vir die Staat ontleed en as volg voortgegaan.]

Beskuldigde nr 1 het sy saak gesluit sonder om getuienis af te lê maar C beskuldigde nr 2 het wel getuienis afgelê. Wat beide beskuldigdes betref is dit gemene saak dat daar geen verskil tussen hulle sake is nie: as die een skuldig bevind moet word dan moet ek ook bevind dat die ander skuldig is, en omgekeerd.

Die tweede beskuldigde het getuienis afgelê vir amper twee dae. Wat 'n D paar aspekte van die saak betref was sy getuienis nie presies nie. Desnietstaande het hy 'n baie goeie indruk gemaak. Sy gedrag was goed en ek is daarvan oortuig dat hy sy bes gedoen het om die waarheid te praat. Insoverre sy getuienis strydig was met dié van die Staatsgetuies verkies ek sy getuienis bo hulle s'n.

Dit volg dat die saak benader moet word op die veronderstelling dat die getuienis van beskuldigde nr 2 minstens rederlikerwys waar kan wees.

E Die algemene regsbeginsels aangaande die diefstal van trustgeld blyk uit die volgende sake. In R v Gush 1934 AD 260 het Hoofregter WESSELS die volgende opmerkings gemaak te 261:

'Where a person receives money on the understanding that he will devote it F to a particular purpose and that purpose only, and he then uses it for his own purposes or pays it into a bank so that the money is used for his own purposes, he commits the crime of theft.'

In dieselfde saak het CURLEWIS AR gesê te 263:

'It frequently happens that a man who unlawfully misappropriates money in this fashion has the intention of repaying the amount but this does not absolve him from the charge of appropriating the money unlawfully.'

G Dit blyk dat dit nie ter sake is nie dat die agent die eienaar van die spesifieke banknote of munte is. Die volgende uittreksels uit drie sake maak dit duidelik.

In R v Manuel 1953 (4) SA 523 (A) het Appèlregter GREENBERG gesê te 526:

H 'It must be borne in mind that, under our modern system of banking and paying by cheque or kindred process, the question of ownership in specific coins no longer arises in cases where resort to that system is made. Even if an agent receives currency on behalf of a principal, there is ordinarily no obligation on him to hand over the notes or coin received by him to his principal. Nevertheless it is trite law that this is trust money and that if he does not pay over to his principal what he has received (in the absence of set-off or other valid reason) and uses the fund for his own purposes he is guilty of theft.'
