Dr Christoph Jaehne makes a very valuable contribution to and at
a very crucial time during the present comprehensive South African
company law reform process.
He highlights the importance for sustained economic growth of the
available dedicated business forms addressing the reasonable expec-
tations and requirements of small and medium-sized businesses, for
sustained economic growth. In looking at the close corporation from
a German perspective and taking into account, inter alia, the very
positive reaction this business form recently received internationally,
and specif‌ically in the United states, he contributes a very vauable
perspective to the present South African reform discussion.
The highly signif‌icant results of this comparison, emphasising the im-
portance of the continued availability of the close corporation and its
potential as a role model for an eventual Societas Africaea furthering
socio-economic integration within the context of SADEC, the African
Union, and NEPAD not only serve as a highly signif‌icant indication
of the importance of the preservation and development of such legal
entities but also sounds as a very timely note of warning to South
African law reformers especially, to proceed more cautiously and with
far geater deliberation.
