Wanneer vonnis vir 'n globale bedrag gegee word, kan die vonnisskuldeiser dit alleen verhaal by wyse van uitwinning of sekwestrasie. Wanneer die Hof egter paaiemente beveel het, dan het die Hof voorskrifte gegee oor die wyse van betaling en is dit nie 'n bevel ad pecuniam solvendam nie, maar wel 'n bevel ad factum praestandum. In so 'n geval is versuim om dit na te kom minagting van die Hof en die Hof sal dit met gevangesetting straf. Dit is 'n gemeenregtelike remedie wat deur Reël 45 (12) (j) en (k) van die Eenvormige Hofreëls onaangetas gelaat is. Wat deur artikel 4 van Wet 21 van 1942 uitgesluit word is siviele gyseling weens skuld (met sekere uitsonderinge). Daar is geen sprake van dat hierdie artikel die Hof se gemeenregtelike magte in gevalle van minagting weggevee het nie. Die mag wees dat Reël 45 (12) (i) van die Eenvormige Hofreëls nou iets wat wesenlik dieselfde is as siviele gyseling weens kontraktuele skuld teruggebring het, maar dit het die Wetgewer in 1942 nie voorsien nie, want die Hooggeregshof het indertyd in geen provinsie die mag gehad om afbetaling van skuld in paaiemente te beveel nie.

When judgment is given for a globular amount the judgment creditor can only recover it by execution or sequestration. When the Court has ordered payment by instalments, however, then the Court has given directions as to the manner of payment and it is not an order ad pecuniam solvendam but an order ad factum praestandum. In such a case failure to comply is contempt of Court and the Court will punish it with imprisonment. This is a common law remedy which is left untouched by Rule 45 (12) (j) and (k) of the Uniform Rules of Court. What is excluded by section 4 of Act 21 of 1942 is civil imprisonment for debt...
