DRAFT ORDER

1.

The administrative action of the first respondent dated approximately 11 March 2008, by refusing to accept the recommendation of the second applicant to expel the learner defined in the founding affidavit from the first applicant is hereby reviewed, set aside and annulled;

The said learner is hereby expelled from the First Applicant with effect from 5 December 2008;

The first respondent is ordered to pay the costs of this application.
