Hiemstra, HR.:

Die beskuldigde is skuldig bevind aan strafbare manslag en gevonnis tot ses jaar gevangenisstraf. Hy doen aansoek om 'n regtersertifikaat ten einde persoonlik te appelleer, maar ek sal die geval afhandel kragtens art 304 (4) van die Strafproseswet 51 van 1977 asof dit D op hersiening voor my gekom het.

Die oorkonde is in 'n hopelose toestand. Die meganiese opneemtoestel het nie behoorlik gewerk nie, en in wat daar op die oorkonde staan kan ek geen inkriminerende getuienis vind nie.

Die streekmagistraat rapporteer dat dit op hierdie stadium onmoontlik is om die oorkonde te rekonstrueer. Hy sal dit heeltemal uit sy geheue moet E doen, en dit vind hy nie moontlik nie. Daar bestaan goed gevestigde voorskrifte, wat nog steeds berus op R v Wolmarans 1942 TPD 279, oor wat gedoen moet word om 'n oorkonde wat onvolledig is, in orde te kry. Maar waar so iets onmoontlik is, en die beskuldigde appelleer, moet die appèl slaag. 'n Skuldigbevinding kan nie gehandhaaf word in 'n notulerende hof, F indien daar geen oorkonde bestaan wat as basis vir die skuldigbevinding kan dien nie.
