Die D beskuldigde het in die Bethlehemse landdroshof tereggestaan op 'n aanklag van roof. Hy het onskuldig gepleit maar is skuldig bevind aan aanranding met die opset om ernstig te beseer en is gevonnis tot 'n boete van R50 of 50 dae gevangenisstraf en daarbenewens tot 100 dae gevangenisstraf, maar laasgenoemde is opgeskort vir drie jaar op voorwaarde dat die beskuldigde nie skuldig bevind word aan E aanranding met die opset om ernstig te beseer wat hy gedurende die tydperk van opskorting pleeg nie.

Die klaer se getuienis op die kernpunt van die aanklag was soos volg:

"Ek ken die beskuldigde se naam. Ons het nie voorheen moeilikheid gehad nie. Op 2 Junie 1975 om 8.00 nm. was ek op pad na my huis gewees. By die hek van die hostel waar ek bly het ek die beskuldigde ontmoet. Beskuldigde het van die kroeg se kant gekom. Beskuldigde het gese ek F moet vir hom geld gee. Ek weier toe. Hy jaag my toe. Ek was bang dat hy my geld sou neem. Ek het weggehardloop toe hy na my toe kom.

Terwyl ek gehardloop het, het ek omgekyk oor my linkerskouer. Beskuldigde het agter my aangehardloop. Dit is toe dat beskuldigde na my met 'n klip gooi. Tref my op my linkeroog. Ek het as gevolg van die hou op die grond geval. Beskuldigde het toe by my gekom en my geld geneem. Ek het my geld G in my oorpak by linkerkant sak gesit. Hy het die R1 uit die sak gehaal.

Ek kon hom nie keer nie want ek het pyn gehad en my gesig was vol bloed gewees.

Die beskuldigde het klaer se getuienis algeheel weerspreek. Hy het beweer dat hulle handgemeen geraak het, dat hy hom A wel met 'n klip gegooi het, maar dat klaer nie geval het nie en dat hy, beskuldigde, toe weggehardloop het en geen geld van klaer...
