Stafford R:

Die drie beskuldigdes is in die landdroshof te Nelspruit skuldig bevind op 'n aanklag van diefstal en beskuldigdes 2 en 3 D is onderskeidelik tot 24 en 36 maande gevanggenisstraf gevonnis. Beskuldigde 1 is ook aan diefstal skuldig bevind maar 'n boete van R2 000 of 12 maande gevangenisstraf opgelê. Al drie die beskuldigdes het skuldig gepleit en hulle skuldigbevindings sowel as beskuldigde 1 se vonnis is onaanvegbaar.

Ten tye van die pleging van bovermelde misdrywe was die landdroshof se jurisdiksie nog beperk tot 12 maande gevangenisstraf. Op 7 Oktober 1998 is die strafjurisdiksie van die landdroshowe verhoog tot drie jaar gevangenisstraf en sedertdien kan 'n landdros in die landdroshof wel 'n periode van drie jaar gevangenisstraf oplê. E

F Die eintlike vraag wat nou ontstaan is of die landdros by magte was om die twee beskuldigdes ooreenkomstig die verhoogde strafjurisdiksie te vonnis. In R v Sillas 1959 (4) SA 305 (A) op 311G - H het Schreiner AR soos volg opgemerk:

'I have consulted the authorities mentioned in the judgment in Mazibuko's case and those referred to in Voet 1.3.17. They do not in general deal with the G reduction of a penalty. The language of Voet, however, in the passage cited shows that, in saying (Gane's translation I, p 47):

"If a penalty has to be imposed for wrongdoing committed before a new law which perhaps sharpens the penalties, then it must be inflicted according to the terms of the old and not of the succeeding new law.",

H he had in mind primarily the case, which is unfortunately the commonest, of an increased penalty.'

'By oorweging van die vraag of 'n bepaalde wetsbepaling terugwerkend is al dan nie, moet van die algemeen erkende vermoede uitgegaan word dat die I wetgewer slegs toekomstige aangeleenthede wil tref en nie sake van die verlede nie.'

Volledigheidshalwe lees die kopstuk in Sillas se saak soos volg op 3056:

'All sentences must be imposed upon conviction. If this is not expressed it is implied. . . .

J A penalty cannot without express words or clear implication, be increased against a wrongdoer after the commission of the offence.'

Daar is niks in art 6 van Wet 66 van 1998 (die verhoogde jurisdiksie bepaling) of êrens anders in die Wet wat bepaal of enigsins A impliseer dat die betrokke artikel van terugwerkende krag is nie.

Dit blyk dus duidelik dat die landdros nie, ten spyte van die wysiging ten opsigte...
