The rights to dignity, to privacy and the integrity of every person are basic to the ethos A of the Constitution and to any defensible civilisation. Women in South Africa are entitled to the protection of these rights. They have a legitimate claim to walk peacefully on the streets, to enjoy their shopping and their entertainment, to go and come from work, and to enjoy the peace and tranquillity of their homes without the B fear, the apprehension and the insecurity which constantly diminishes the quality and enjoyment of their lives. The Courts are under a duty to send a clear message to the accused in the present case, to other potential rapists and to the community that the Courts are determined to protect the equality, dignity and freedom of all women, and they will show no mercy to those who seek to invade those rights. In the present case the Court dismissed the appellant's appeal against his conviction on three counts of rape and the sentence of seven years' imprisonment imposed on each of the counts, the sentence on the first count having been ordered to run concurrently with the sentences imposed on the second and third counts (ie an effective sentence of D 14 years' imprisonment). The Court, in dismissing the appeal against the sentences, pointed out that the appellant had shown no respect for the rights of the complainants; he had prowled the streets and shopping malls and in a short period of one week had raped three young women who were unknown to him; he had deceptively pretended to care for them by giving them lifts and had then proceeded to rape them callously and brutally, after threatening them with a knife; and at no stage had he shown the slightest remorse.
