Cautionary rules

The Supreme Court of Namibia in

S v Katamba

2000 (1) SACR 162 (NmS) was

unable to fully endorse the obiter dictum of Frank J in

S v D

1992 (1) SACR

143 (Nm) to the effect that the cautionary rule has no rationale basis and was

contrary to the provisions of the Namibian Constitution. Nevertheless,
