C The Court (per CORBETT JA), in an appeal against the judgment of the Full Bench of the Orange Free State Provincial Division (DE WET J, FLEMMING J and KOTZÉ AJ) (reported as Decro Paint and Hardware (Pty) Ltd v Plascon-Evans Paint (Tvl) Ltd 1982 (4) SA 213 (O)) upheld the appeal, insofar as it related D to the issue of infringement, for reasons similar to those in the matter Plascon-Evans Paints Ltd v Van Riebeeck Paints (Pty) Ltd reported ante at 1984 (3) SA 623 (A). As regards the issue of passing off, the Court, substantially for the reasons stated by the Court a quo at 219D - 222B, held that the claim for an interdict should fail.
