Dit is in die Transvaalse Provinsiale Afdeling toelaatbaar om in 'n G aansoek om vonnis by verstek in 'n aksie om skadevergoeding die getuienis van deskundiges soos, byvoorbeeld, medici, werktuigkundiges, waardeerders en andere, by wyse van eedsverklarings voor die Hof te plaas. Dit sal dikwels kostebesparend wees en sal nodelose verkwisting van Hoftyd uitskakel. Dit is tyd dat hierdie praktyk deur die Regbank aangemoedig word. Dit is vanselfsprekend dat die Hof die bevoegdheid behou om waar H verdere toeligting benodig word en viva voce getuienis raadsaam geag word, dit te vereis.

It is permissible in the Transvaal Provincial Division, in an application for default judgment in an action for damages, to place before the Court the evidence of experts, such as, for example, medical practitioners, J mechanics, valuers and others, by way of

A affidavits. This will often save costs and will eliminate the unnecessary wastage of Court time. It is time that this practice was encouraged by the Bench. It goes without saying that the Court retains the power to require viva voce evidence, where further information is required and such evidence is considered advisable. B

Judgment

Van, Dijkhorst R.:

Dit is 'n eis om skadevergoeding voortvloeiend uit 'n skietvoorval waartydens die eiser aan sy linkerbeen verwond is. Hy is deur sy destydse verloofde wederregtelik en opsetlik met 'n .38 rewolwer geskiet. Die verweerderes verdedig nie die saak nie en dit is 'n aansoek om vonnis by verstek.

D Ten einde sy skade te bewys is, onder andere, die deskundige getuienis van 'n ortopeed, dr Birrell, nodig. Oorwegings van koste en ongerief het die eiser se advokaat genoop om die getuienis by wyse van beëdigde verklaring voor te lê. Dit is egter gebruiklik in hierdie Afdeling dat deskundige getuienis van hierdie aard, en ook in ander gevalle soos die E bewys van waardeverlies van of skade aan voertuie voortvloeiend uit motorbotsings, viva voce voorgelê word.

Die vraag wat dus eers beantwoord moet word, is of dit 'n geval is...
