Faced with the task of interpret ing or giving effect to the Children’s Act 38
of 2005, there may be a number of sources which one may consult, but I submit
that none will be as comprehensive – and ver y few as author itative – as Juta’s
Commentary on the Children’s Act. This new kid on the block is a section-by-
section guide to the new piece of legislation which partly came into force on
1 July 2007 and, like all children and the Act itself, has been described as a
“work in progress”. Certai n sections (and even whole chapters) of the Act a re
still due to come into operation and it is probable that the publishers were con-
sequently compelled to publish this commentary in a loose-leaf format. T he
publication thus includes a funct ional summary (on page iv) of those sections
that are currently operational. The Revision Service of this publication (which
was submitted for review) however, still refer s to the Children’s Amendment
