In verband met die berekening van skadevergoeding vir liggaamlike beserings in aksies om skadevergoeding deur vergelyking met toekennings in vroeëre sake, is dit in die algemeen nie gerade om 'n aanpassing vir die verminderde waarde van geld te maak deur die slaafse navolging van syfers wat in die verbruikersprysindeks voorkom nie. Dit kan die beweegruimte van 'n Verhoorhof by die vasstelling van die quantum van algemene skadevergoeding te veel aan bande lê.

In 'n aksie om skadevergoeding weens persoonlike beserings wat die eiser (respondent) opgedoen het weens die beweerde nalatigheid van C, die bestuurder van 'n kombi deur die verweerder (appellant) verseker, het dit geblyk dat die eiser 'n bakkie bestuur het op 'n betreklik nou pad in die platteland, om ongeveer 9.30 nm, toe C van die teenoorgestelde rigting agter 'n Mazda aangekom het. 'n Oogwink nadat eiser die Mazda verby gery het, het die regter kante van die bakkie en die kombi in botsing gekom. Volgens eiser het C, kort voor die botsing, agter die Mazda uitgeswaai tot op sy verkeerde kant van die pad, en, oenskynlik omdat dit duidelik was dat eiser se aankomende bakkie te naby aan hom was om die Mazda verby te steek, toe weer vinnig na sy korrekte kant van die pad teruggeswaai, maar die bakkie getref het voordat hy kon slaag om heeltemal terug te kom tot op sy korrekte kant van die pad. Die Verhoorhof het feitlik sy weergawe aangeneem en dié van C verwerp. Daardie Hof het bevind dat C die gevaar van 'n botsing geskep het toe hy uitgeswaai het en sy ligte op skerp gesit het, en dat sy skuld ten opsigte van die botsing aansienlik was, maar dat die eiser ook nalatig was deurdat hy te naby aan die middel van die pad gery het en nie, in die halwe sekonde tot sy beskikking vandat die gevaartoestand ontstaan het, na sy linkerkant toe geswaai het nie. Die Verhoorhof het toe die skuld in die verhouding van 75 teenoor 25 ten gunste van die eiser verdeel. In 'n appèl deur die versekeraar,

Beslis, dat appellant geen gronde aangetoon het om die Appèlhof in staat te stel om met die Verhoorhof se feitebevinding in te meng nie.

Beslis, verder, dat, selfs word daar 'n ietwat langer tyd om op te tree aan die kant van die eiser veronderstel, daar nog geen voldoende gronde sou wees om die Verhoorhof se verdeling van die skuld tersyde te stel nie.

In 'n appèl deur die verweerder teen, onder andere, die toekenning van skadevergoeding in 'n Provinsiale Afdeling in 'n aksie om skadevergoeding voortspruitende uit die botsing waarin die respondent (eiser) die gesig van een oog verloor het, die eiser synde 'n Kleurling plaasarbeider wat tydens die verhoor 29 jaar oud was, het die Hof die eiser se algemene skadevergoeding vasgestel op 'n allesomvatende bedrag van R10 000 en derhalwe die Verhoorhof se vasstelling van R9 700 bekragtig nieteenstaande die feit dat die Verhoorhof 'n fout in die berekening van die skadevergoeding begaan het. Daar was geen teen-appèl deur die eiser nie.

Die beslissing in die Kaapse Provinsiale Afdeling in Sodoms v AA Onderlinge Assuransie Assosiasie Bpk bevestig.

In connection with the assessment of damages for bodily injuries in actions for damages by comparison with awards in earlier cases, it is in general not advisable to make an adjustment for the depreciation in the value of money by slavishly following figures appearing in the consumer price index. That can limit too much a trial Court's elbow room in the assessment of the quantum of general damages.

In an action for damages for personal injuries which the plaintiff (respondent) sustained on account of the alleged negligence of C, the driver of a kombi insured by the defendant (appellant), it appeared that the plaintiff had driven a "bakkie" on a rather narrow road in a country district, at about 9.30 pm, when C approached from the opposite direction behind a Mazda. moment after plaintiff passed the Mazda, the right side of the bakkie collided with the right side of the kombi. According to plaintiff C, shortly before the collision, had swung out behind the Mazda onto its incorrect side of the road and, apparently because it was clear that plaintiff's approaching bakkie was too near for him to overtake the Mazda, then quickly swerved back towards his correct side of the road, but had hit the bakkie before he could succeed in getting back onto his correct side of the road.
