Eiser vorder van die twee verweerders gesamentlik en afsonderlik betaling van 'n bedrag van R2 000 vir skade gely as gevolg van beweerde aanrandings op hom deur wyle N. L. van den Berg en tweede verweerderes op 18 April 1970. Die gebeure wat tot die eis

aanleiding gegee het, het plaasgevind tydens 'n politieke vergadering van die Herstigte Nasionale Party in die Eeufeessaal op Mafeking.

Eiser beweer in sy besonderhede van vordering dat hy "opsetlik, onregmatig en animo injuriandi" deur wyle van den Berg, wat na A instelling van die aksie oorlede is, en tweede verweerderes aangerand is deurdat van den Berg hom minstens twee houe met die vuis in die gesig geslaan het en dat tweede verweerderes hom met 'n skoen oor die kop geslaan het. Eiser beweer dat hy beserings opgedoen het en beledig is, en beweer verder dat van B den Berg en tweede verweerderes gesamentlik opgetree het en gesamentlik en afsonderlik teenoor hom aanspreeklik is.

In die verweerskrif word erken dat van den Berg vir eiser een hou met die vuis op sy linker oog geslaan het maar dit word gepleit dat die gemelde hou in noodweer toegedien is onmiddellik nadat eiser vir van den Berg met die vuis op die oog geslaan het. In die alternatief word gepleit dat die C vuishou wat van den Berg eiser toegedien het, toegedien is

"in die hitte van die oomblik en as 'n direkte gevolg van ernstige provokasie aan die kant van eiser"

welke provokasie, so word beweer, bestaan het uit die feit dat eiser vir van den Berg sonder wettige rede aangerand het deur hom met die vuis op die oog te slaan en dat eiser in die D omstandighede nie geregtig is om enige skadevergoeding te verhaal nie. Dit word verder erken dat tweede verweerderes vir eiser twee houe met haar skoen oor die kop geslaan het maar dit word beweer dat toe sy so gehandel het eiser vir haar seun, Hannes van Niekerk, om die nek beetgehad het en besig was om E hom te verwurg en dat tweede verweerderes gehandel het in wettige verdediging van haar seun. In die alternatief word ook gepleit dat tweede verweerderes die houe met die skoen toegedien het in die hitte van die oomblik en as 'n direkte gevolg van ernstige provokasie aan die kant van eiser deurdat laasgenoemde tweede verweerderes se seun onwettiglik aangerand F het en besig was om hom te verwurg en dat eiser gevolglik nie geregtig is om enige skadevergoeding van haar te verhaal nie.

Behalwe vir bogemelde erkennings ontken verweerderes al eiser se bewerings en hulle ontken gevolglik ook die bewerings dat hulle onregmatig en animo injuriandi gehandel het en ontken ook dat van den Berg en tweede verweerderes gesamentlik en afsonderlik aanspreeklik is.
