Eloff, R.:
Die appellant het die respondente in 'n landdroshof aangespreek B op grond van 'n borgakte wat sy op 15 September 1967 geteken het. Die akte bepaal dat sy haarself teenoor appellant bind as borg en mede hoofskuldenaar in solidum vir die behoorlike betaling deur J F S Ungerer van alle bedrae wat hy toe of in die toekoms aan appellant mag skuld. Ons C is tans slegs gemoeid met dié verweer wat respondente ge-opper het dat haar verantwoordelikheid teenoor appellant verval het deurdat hy 'n skikkingsooreenkoms met die genoemde Ungerer aangegaan het in terme waarvan laasgenoemde 'n bedrag van R750 sou betaal in volle vereffening van appellant se eis teen hom van R1 042,07. Dit was gemeensaak dat so 'n skikking inderdaad aangegaan is, en Ungerer het die bedrag van R750 aan D appellant betaal. Vanweë daardie betaling vra appellant slegs vir vonnis teen respondente in die som van R292,07. Dit was ook gemeensaak dat hoewel appellant vir R750 geskik het, sy regmatige eis teen Ungerer werklik vir R1 042,07 was.
Dit dien ten aansien van die feite verder gemeld te word dat Ungerer (wat E as eerste verweerder saam met respondente in die hof benede gevoeg was, en teen wie die geding voortgesit is tot die aangaan van die genoemde skikking) in sy pleit alle aanspreeklikheid teenoor appellant ontken het. Die skikking het derhalwe ingehou dat appellant minder aanvaar het as die oorspronklike eis, en Ungerer het iets betaal terwyl hy beweer het dat hy niks skuld nie. Dit was dus 'n ware geval van transactio, met die F uitwerking dat die vroëere verbintenis of vermeende verbintenis uitgewis en 'n nuwe verbintenis daargestel word (vgl Cachalia v Harberer & Co 1905 TS 457 te 462).
Hoewel respondente haarself as borg en mede hoofskuldenares in solidum verbind het, en dus in dieselfde posisie as 'n hoofskuldenaar teenoor appellant te staan gekom het, bly sy 'n borg en haar aanspreeklikheid G behou 'n aksesore karakter. Vanweë daardie eienskap van haar verhouding volg dit dat indien die hoofskuld tot niet sou gaan, sy insgelyks vrygestel sou word (Moti and Co v Cassim's Trustee1924 AD 720 te 737, 742). Die rede is dat:
"... it incapacitates the creditor from ceding to the surety his actions H against the debtor as effectually as if he had voluntarily surrendered them; its operation therefore is to release the surety."
