Steyn, R.:
Beskuldigde was aangekla van (a) aanranding met die doel om ernstig te beseer en (b) huisbraak met die doel om te steel en diefstal.
A Ten opsigte van die eerste klagte het hy skuldig gepleit, is hy tereg skuldig bevind en is hy gevonnis tot vier maande gevangenisstraf en vyf houe. Nòg die skuldigbevinding nòg die vonnis verwerdig enige kommentaar aangesien geen tersaaklike probleem uit hoofde daarvan ontstaan nie.
Die tweede hierbovermelde oortreding ten opsigte waarvan die beskuldigde B onskuldig gepleit het en skuldig bevind is, opper egter sekere probleme wat straftoemeting aanbetref. Myns insiens was die beskuldigde sonder twyfel tereg deur die landdros skuldig bevind ook ten opsigte van hierdie oortreding. Na skuldigbevinding is die volgende vorige oortredings teen die beskuldigde bewys en erken:

Ten opsigte van hierdie tweede klagte het die landdros 'n vonnis van vier maande gevangenisstraf opgelê. Voordat die saak vir outomatiese D hersiening aan hierdie Hof opgestuur is, het sekere verdere gegewens tot die landdros se aandag gekom. Dit blyk dat aangesien 'n afsonderlike polisiedossier ten opsigte van elkeen van die klagtes geopen is 'n rekord vorm S.A.P. 69B, wat ander gegewens bevat, in antwoord op die Kriminele Buro aangevra is. In antwoord op die een aanvraag is die lys E vorige veroordelings op vorm 69B waarna hierbo verwys is terug ontvang. Die saak is toe afgehandel op die basis dat dit die korrekte vorige veroordelings van die beskuldigde weerspieël. Kort daarna is 'n ander rekord vorm S.A.P. 69B, wat ander gegewens bevat, in antwoord op die ander navraag ontvang. Hierdie S.A.P. 69B lees soos volg:

Soos duidelik uit hierdie tweede stel vorige veroordelings blyk (waarna ek as stel B sal verwys en die eerste stel as A) sou die beskuldigde gekwalifiseer het vir 'n vonnis van gevangenisstraf ter voorkoming van misdaad, na skuldigbevinding op die klagte van huisbraak en diefstal. Die landdros het voorgestel dat die vonnis ter syde gestel word en dat die saak na hom terugverwys word vir afhandeling.
