Die appellant, 'n 25-jarige Swartman, is as beskuldigde nr 1 saam met Rama Joshua Mishali as beskuldigde nr 2 in die

Joubert AR
Witwatersrandse Plaaslike Afdeling voor LE ROUX R van moord A aangekla deurdat hulle gedurende die aand van 27 November 1981 die oorledene, David Lungile Mogazi, te Emdeni, Johannesburg-distrik, vermoor het. Hulle het onskuldig gepleit en hulle is verhoor. Die appellant is skuldig bevind aan poging tot moord en gevonnis tot drie jaar gevangenisstraf. Beskuldigde nr 2 is skuldig bevind aan moord met versagtende B omstandighede en gevonnis tot sewe jaar gevangenisstraf. Met spesiale verlof kom die appellant nou in hoër beroep na hierdie Hof teen sy skuldigbevinding.
Die relevante gebeure is kortliks soos volg. Die betrokke aand het die twee beskuldigdes saam met Fanie Tshabalala, Abel Phofu en Oupa Mpumani 'n smokkelhuis in Emdeni besoek. Die oorledene C was ook daar in die geselskap van 'n ander groep bestaande uit Prins Ndluli, Theophilus Mutombo en Norman Sitole. Toe die smokkelhuis sluit, het die twee groepe in dieselfde rigting tot by die hoek van die eerste dwarsstraat geloop.
