In 'n aansoek om kondonasie van gebrekkige prosedure op appèl (in die huidige geval, die laat aantekening van die appellant se appèl na 'n Provinsiale Afdeling teen sy skuldigbevinding en vonnis in 'n streekhof) C is die vraag of redelike vooruitsigte van sukses op appèl aangetoon is 'n mindere toets as dié wat toegepas word om te besluit of 'n appèl behoort te slaag of nie.
Waar die Appèlafdeling, in hoër beroep, 'n Provinsiale Afdeling se weiering om kondonasie (soos voormeld) te verleen, omvergewerp het, is die Appèlafdeling nie by magte om die appèl op die meriete (dws, in die D huidige geval, die appèl teen die skuldigbevinding en vonnis) aan te hoor nie. Daar bestaan, na aanleiding van art 309(1)(a) van die Strafproseswet 51 van 1977 en art 21 van die Wet op die Hooggeregshof 59 van 1959, geen voorsiening vir 'n regstreekse appèl na die Appèlafdeling teen 'n skuldigbevinding deur 'n landdros nie. Na omverwerping van die Provinsiale Afdeling se weiering van kondonasie, moet die aangeleentheid E na die Provinsiale Afdeling terugverwys word vir die aanhoor van die appèl op die meriete.

H In an application for the condonation of defective procedure on appeal (in the present case, the late noting of the appellant's appeal to a Provincial Division against his conviction and sentence in a regional court), the question whether reasonable prospects of success on appeal have been shown is a lesser test than that which has to be applied in deciding whether the appeal ought to succeed or not.
I Where the Appellate Division has, on appeal to it, reversed a Provincial Division's refusal to grant condonation (as aforestated), it (the Appellate Division) does not have the power to hear the appeal on the merits (ie, in the present case, the appeal against the conviction and sentence). Having regard to s 309(1)(a) of the Criminal Procedure Act 51 of 1977 and s 21 of the Supreme Court Act 59 of 1959, no provision has been made for an appeal directly to the Appellate Division against a J conviction by a
