Die beskuldigde (appellant) is in 'n landdroshof skuldig bevind aan opsetlike saakbeskadiging en gevonnis tot drie maande gevangenisstraf. G Die beskuldigde het gedurende die landdroshofverrigtinge geweier om te pleit. Namens die beskuldigde is in hoër beroep aangevoer dat aangesien dit ex facie die oorkonde blyk dat die landdros nooit aan die beskuldigde verduidelik het dat hy op regsverteenwoordiging geregtig was nie, die verrigtinge vernietig en tersyde gestel behoort te word.

Beslis, dat daar in die algemeen 'n plig op voorsittende beamptes rus om H beskuldigdes in te lig omtrent hul reg op regsverteenwoordiging.

Beslis, verder, dat die benadering en optrede van die beskuldigde vir die landdros aanduidend moes gewees het dat hy die saak in 'n ernstiger lig as die gewone een van opsetlike saakbeskadiging moes beskou het.

Beslis, verder, dat die versuim om die beskuldigde in te lig aangaande sy reg op regsverteenwoordiging derhalwe 'n onreëlmatigheid was wat I neer- gekom het op 'n regskending, en dat die verrigtinge dus tersyde gestel moes word ooreenkomstig art 309 van die Strafproseswet 51 van 1977.

A Beslis, verder, dat aangesien terugverwysing van die verrigtinge na die hof a quo kragtens art 313 van die Strafproseswet waarskynlik die beskuldigde sou benadeel, die skuldigbevinding en vonnis sonder sodanige terugverwysing tersyde gestel moes word.

The accused (appellant) was convicted of malicious injury to property in D a magistrate's court, and sentenced to three months' imprisonment. The accused had refused to plead during these proceedings. On appeal it was alleged on behalf of the accused that inasmuch as it appeared ex facie the record that the magistrate had neglected to inform the accused of his right to legal representation, the proceedings had to be set aside.

Held, that there was a general duty on a presiding officer to inform an E accused regarding his right to legal representation.

Held, further, that the attitude and conduct of the accused ought to have given a clear indication to the magistrate that the proceedings had to be viewed in a more serious light than the ordinary case of malicious injury to property.

F Held, further, that the failure to inform the accused of this right to legal representation accordingly constituted an irregularity resulting in a failure of justice, and that the proceedings had to be set aside in terms of s 309 of the Criminal Procedure Act 51 of 1977.
