Van der Walt R:

Die twee beskuldigdes het op 25 Januarie 1978 voor die landdros te Alberton tereggestaan op die volgende aanklagte:

(1)

Diefstal.

(2)

Oortreding van art 141 (2) van Ord 21 van 1966 (gebruik van 'n E voertuig sonder die eienaar se toestemming).

Beskuldigdes het onskuldig gepleit.

Beskuldigde 1 is skuldig bevind op beide klagte en tov klag 1 tot nege maande gevangenisstraf gevonnis. Klag 2 beboet met R90 of 90 dae gevangenisstraf.

Beskuldigde 2 is op klag 1 skuldig bevind en tot ses maande F gevangenisstraf gevonnis.

Die vehoorlanddros het meer as sewe jaar diens.

Beskuldigde 1 is deur die verhoor en tot na uitspraak deur 'n prokureur verteenwoordig.

Die saak is daarop uitgestel na 2 Januarie 1978 sodat vasgestel kan word G of enigeen van die beskuldigdes vorige veroordelings het.

Van der Walt R

Toe die saak op 2 Februarie 1978 om 09h30 geroep word is beskuldigde 1 se prokureur afwesig.

Die landdros het die saak laat afstaan tot 12h35 toe beskuldigde 1 die hof A meedeel dat hy nie sy prokureur kan opspoor nie en versoek dat die saak afgehandel moet word.

Geeneen van die beskuldigdes het vorige veroordelings nie.

Na my mening is die skuldigbevindings en vonnisse in orde en behoort dit bekragtig te word.

B Die verhoorlanddros het egter namens hom en van sy kollegas die volgende skrywe aan die Hersieningsregter voorgelê:

"1.

Die getikte en oorspronklike notule van verrigtinge in bogenoemde saak gaan hiermee.

2.

Ek ondervind probleme met die uitleg van art 302(3) (a) van Wet 51 van 1977. U sal merk dat beskuldigde 1 in die onderhawige saak deur 'n prokureur bygestaan is tot by skuldigbevinding. Hy het toe verdwyn en die verrigtinge na skuldigbevinding is afgehandel sonder dat die C beskuldigde deur 'n regsadviseur bygestaan is.

3.

Die omgekeerde gebeur ook, nl. waar 'n beskuldigde skuldig bevind word en nie regsbystand geniet het nie en dan na skuldigbevinding regsbystand geniet. Daar heers by my en my kollegas onsekerheid oor wat die prosedure in sulke gevalle behoort te wees.

4.

Dit sal waardeer word indien v hierdie skrywe saam met die aangehegte saak aan Sy Edele die Hersieningsregter D sal voorlê vir 'n moontlike beslissing."

My Kollega VILJOEN het kommentaar van die Prokureur-generaal versoek en aangedui dat sy prima facie mening was dat die saak hersienbaar is as die regsverteenwoordiger nie gedurende albei stadia - die verhoor sowel as die vonnisverrigtinge - teenwoordig is nie.

E Die Adjunk Prokureur-generaal het die volgende prikkelende kommentaar gelewer:

"1.

Die voorsiening wat in art 302 vir hersiening in strafsake waar daar 'n skuldigbevinding aangeteken was, gemaak word, vorm 'n onderdeel van die tans geldende hersieningsprosedure.

Ander voorsiening is, bv:

Spesiale hersiening: Art 304 van Wet 51 van 1977,

(b)

art 24 van die Wet F op Hooggeregshowe 59 van 1959,
