C Kriek RP:
Hierdie sake gaan almal oor die ondervraging van 'n beskuldigde ingevolge art 112(1)(b) van die Strafproseswet 51 van 1977 by 'n aanklag van aanranding met die opset om ernstig te beseer. Die eerste vraag is of die hof, indien 'n beskuldigde dolus directus ontken, kan voortgaan met vrae wat daarop gemik is om antwoorde te ontlok wat 'n gevolgtrekking dat die beskuldigde, vir die doeleindes van art 112(1)(b), opset in die vorm van dolus eventualis erken, sal regverdig. In die ongerapporteerde beslissing van Buys R in Staat v De Wee wat op 26 April 1990 gelewer is in hierdie Afdeling, is hierdie vraag bevestigend beantwoord. Ek het met daardie uitspraak saamgestem, maar ek het sedertdien tweede gedagtes begin kry.
E In S v Mkhize 1978 (1) SA 264 (N) sê Didcott R, op 268:
'When the court is called upon to decide whether an accused person's response to its questions adequately support a conviction under s 112(1)(b), F its function is not to evaluate the answers as if it were weighing evidence, or to judge their truthfulness or plausibility. It is simply to interpret them to see whether they substantiate the plea. The test, in short, is what the accused person has said, not what the court thinks of it.'
Soos Snyman Strafreg, op 167 sê:
G 'Opset by moontlikheidsbewussyn is 'n vorm van opset wat afwyk van die gewone betekenis wat opset in die alledaagse spreektaal het.'
'n Beskuldigde ontken die bewering in die klagstaat dat hy die opset gehad het om ernstig te beseer. Nou word hy twee of drie vrae gevra, en as gevolg van sy antwoorde word opset deur die reg aan hom toegedig alhoewel hy dit ontken het. H Dit lyk vir my of dit nie strook met die doel van art 112(1)(b) dat daar vasgestel moet word of die beskuldigde subjektief die bewerings in die klagstaat erken nie.
Ek is egter in die minderheid wat hierdie mening betref aangesien my twee Ampsbroers die mening toegedaan is dat die De Wee beslissing gevolg behoort te word onderhewig aan sekere kwalifikasies. Met daardie kwalifikasies stem ek saam, en ek gaan dus voort op die basis dat die vraag wat ek hierbo gestel het, bevestigend beantwoord word. I
Die agtergrond waarteen die hele aangeleentheid benader moet word is dat art 112(1)(b) in die eerste plek vereis dat daar vasgestel moet word of die beskuldigde die bewerings in die klagstaat sowel as al die elemente van die betrokke misdryf erken.
