Op 'n aanklag dat die beskuldigde wederregtelik en onwettiglik die Republiek binnegekom het terwyl hy 'n verbode persoon was, ter oortreding van artikel 24 (3) gelees met artikels 24 (4) en 24 (1) van die Wet tot Regeling van de Toelating van Personen tot de Unie, 22 van 1913, is mens rea nie 'n element van die misdryf nie. En, selfs indien die beskuldigde heeltemal ter goeder trou was en die oortreding nie van 'n ernstige aard was nie, is die beginsel de minimis non curat lex nie van toepassing nie.

On a charge of wrongfully and unlawfully entering the Republic while he was a prohibited person in contravention of section 24 (3) read with sections 24 (4) and 24 (1) of the Admission of Persons to the Union Regulation Act, 22 of 1913, mens rea is not an element. And, even if the accused was completely in good faith and the contravention was not of a serious nature, the principle de minimis non curat lex is not applicable. C

W. J. Hartzenberg, namens die appellant: Art. 24 (1), 24 (3) en 24 (4) D van Wet 22 van 1913, skep nie 'n absolute verbod nie. Ten einde te kan bevind dat 'n bepaling 'n absolute verbod daarstel moet dit òf duidelik blyk uit die woorde van die Wetgewer òf dit moet afgelei kan word uit ander faktore soos: die verband waarin die verbod geskep is; die doel en strekking van die statuut; die aard van die straf, of die gemak waarmee die Wet oortree kan word. Sien R v H., 1944 A.A. 121; R v Canestra, E 1951 (2) SA 317; S v Arenstein, 1964 (1) SA 361; S v Jassat, 1965 (3) SA 423; S v le Roux, 1969 (3) SA 727; De Wet en Swanepoel, Die Suid-Afrikaanse Strafreg, bl. 91, 92 en 93. Die Wetgewer het nie 'n uitdruklike absolute verbod daargestel nie en daar kan nie, uit die verband waarin die bepaling daargestel is, so 'n bedoeling F afgelei word nie. Ook is die doel en strekking van die statuut nie sodanig dat so 'n verbod daaruit afgelei moet word nie en is die straf sodanig dat dit eerder dui daarop dat die Wetgewer skuld as 'n element van die misdaad sou vereis het. Dit is nie 'n bepaling wat met enige mate van gemak ontduik kan word nie. In hierdie geval was daar geen skuld aan die kant van die beskuldigde nie, aangesien die mense deur die G polisie oor 'n periode van jare toegelaat is om te doen wat hulle gedoen het. Die vee kon wei tot teen die draad. Die draad is soms onder die watermerk van die rivier. Die persone wat so handel dryf Bantoes is en waarskynlik nie vir ander grens as die draad sou soek nie. In ieder geval is hierdie 'n geval waar die Hof die beginsel de minimis non curat lex moes toegepas het. Sien R v Dane, 1957 (2)

Die appellant, 'n volwasse Bantoeman, is in die landdroshof te Louis Trichardt aangekla van 'n oortreding van art. 24 A (3), gelees met art. 24 (4) en art. 24 (1), van Wet 22 van 1913.
