Hierdie is 'n spesiale hersiening. Die beskuldigde, 'n volwasse man, het in die landdroshof vir die distrik Wonderboom verskyn op 'n aanklag van moord. Borg is op 14 November 1995 ten bedrae van R3 000 ten opsigte van die B beskuldigde vasgestel. Een van die voorwaardes waarop borg toegestaan is, was dat die beskuldigde hom moes weerhou van enige kommunikasie of kontak met sekere Staatsgetuies. Direk na afloop van die hofverrigtinge op daardie dag, het die beskuldigde na bewering een van gemelde getuies met die dood gedreig. 'n Aansoek dat die borgtog ingetrek word is op 11 Desember 1995 deur die Staat gedoen.

Na aanhoor van getuienis het die landdros 'n bevel gemaak dat beskuldigde se borg ingevolge art 66(3) van Wet 51 van 1977 ('die Wet') ingetrek en aan die Staat verbeurd verklaar word. Daarbenewens het die landdros die beskuldigde ook C skuldig bevind aan 'n oortreding van art 67A van die Wet soos ingevoeg deur Wet 75 van 1995, en is die beskuldigde gevonnis tot 90 dae gevangenisstraf.

Die saak is toe deur die landdros op spesiale hersiening voorgelê omdat hy nie bewus was dat die beskuldigde op die stadium van sy bevel nog nie die borggeld betaal het nie en nie op borgtog vrygelaat is nie. Die landdros versoek ook dat die skuldigbevinding en vonnis, wat ingevolge art 67A van die Wet plaasgevind het, D tersyde gestel word en dat die borgbevel ingetrek bly totdat die saak weer voor hom gebring word sodat hy sy diskresie kan uitoefen met betrekking tot borgtog nadat hy nuwe feite aangehoor het.

'n Ampsbroer voor wie die spesiale hersiening gedien het, het per errorem E gesertifiseer dat hy van oordeel is dat reg behoorlik in die saak geskied het.

Die saak is gevolglik weereens voorgelê vir spesiale hersiening. Ek het die Prokureur-generaal vir sy kommentaar gevra. Adv J H C van Heerden, met wie adv D F de Beer SC, adjunk Prokureur-generaal, saamstem, het goedgunstiglik deeglike F kommentaar gelewer, waarvoor hulle bedank word.

Namens die Prokureur-generaal word, myns insiens, tereg aangevoer dat, in die lig van die getuienis op rekord, geen kritiek op die bevinding van die landdros dat die beskuldigde wel die Staatsgetuies gedreig het, uitgespreek kan word nie.

Die eerste vraag wat ontstaan is of art 66 op die onderhawige geval van toepassing G is aangesien die borggeld nie betaal is nie en die beskuldigde nie vrygelaat is nie.
