Die appellant is deur Regter DE VILLIERS en twee A assessore in die Witwatersrandse Plaaslike Afdeling skuldig bevind op drie aanklagte van moord. Die Hof het bevind dat daar geen versagtende omstandighede is nie en het gevolglik, kragtens art. 330 van die Strafproseswet, 56 van 1955, die doodvonnis opgelê.
Nadat verlof tot appèl verkry is, kragtens art. 363 (8) van B genoemde Wet, het die appellant in hoër beroep na hierdie Hof gekom teen sy vonnis. Op 24 Julie 1975 het hierdie Hof die appèl afgewys en aangedui dat sy redes vir uitspraak later verstrek sou word. Die redes vir die Hof se uitspraak is die volgende.
Die appellant is 'n Blanke man, nou 30 jaar oud. Vir 'n geruime C tyd voordat hy die betrokke misdade gepleeg het, het hy nie gewerk nie. Hy het 'n verhouding aangeknoop met 'n Blanke vrou, Johanna van Jaarsveld. Hulle twee het bedags in die strate van Johannesburg rondgeloop en geld gebedel van mense aan wie hulle valse stories opgedis het van teenspoed wat hulle sou gehad het. Die geld wat hulle so bekom het, is uitgegee hoofsaaklik in die aankoop van drank. Hulle het geen tuiste gehad nie en D het geslaap net waar hulle kon.
Daar was ook 'n ander manier waarop die appellant en Van Jaarsveld geld bekom het. Dit word soos volg beskryf in die uitspraak van Regter DE VILLIERS:
'Daar was ook 'n ander wyse van optrede, naamlik dat Van Jaarsveld vriende sou maak met manspersone, dat sy hierdie E persone dan na 'n kamer sou vergesel met die doel om geslagtelike gemeenskap te hê, waar die slagoffer òf beroof òf afgepers is, nadat beskuldigde (appellant) onverwags sy opwagting gemaak het.'
Elkeen van die drie vermoorde persone is op genoemde wyse na 'n kamer gelok waar hy aangeval en vermoor is. Twee van die persone is gedurende November 1973 in Johannesburg om die lewe gebring, en die derde een gedurende Maart 1974 in Port F Elizabeth, waar die appellant en Van Jaarsveld hulle toe bevind het.
Op 5 Maart 1974 is die appellant en Van Jaarsveld naby Humansdorp in hegtenis geneem. Daarna het appellant en Van Jaarsveld by 'n voorlopige verhoor verskyn. As gevolg van mediese ondersoeke is Van Jaarsveld verwys na die Sterkfontein G Hospitaal as 'n Staatspresidentse pasiënt. Die appellant was dus die enigste beskuldigde by die verhoor.
Voordat die toepaslikheid van die vonnis bespreek word is dit nodig om kortliks te beskryf hoedat die drie slagoffers vermoor is. Die eerste klagte het betrekking gehad op 'n Blanke man, Gerhardus Marthinus Scheepers, 62 jaar oud, wat alleen gewoon H het in 'n woonstel in de Villiersstraat, Johannesburg. Die appellant en Van Jaarsveld het hom op die aand van 25 November 1973 na sy woonstel vergesel. 'n Dag of twee daarna is die oorledene in die woonstel dood aangetref.
