Die appellant het in 'n Plaaslike Afdeling tereggestaan op 'n aanklag G van moord. Na die Staatsadvokaat sekere inligting aan die Verhoorregter gegee het, het die Verhoorregter besluit dat dit onwaarskynlik was dat die doodvonnis opgelê sou word, en het hy besluit om nie assessore aan te stel nie. Die verhoor het eater 'n onvoorsiene wending geneem toe die appellant 'n ander verweer aangeneem het as die wat die Staat verwag het. Die Hof het bevind dat daar geen versagtende omstandighede was nie H en het gevolglik die doodvonnis opgelê. Die Verhoorregter het verlof om teen die bevinding te appelleer verleen en die vraag geopper of die feit dat hy nie die voordeel van beraadslaging met en die menings van assessore gehad het nie moontlik 'n faktor was wat die Hof op appèl mag beïnvloed in sy beslissing of daar wel versagtende omstandighede was al dan nie. Die Hof op appèl het bevind dat, in die omstandighede, daar geen onredimatighede begaan is nie. Die skuldigbevinding aan moord sonder versagtende omstandighede is bekragtig en die appèl is van die hand gewys.

The appellant had appeared in a Local Division on a charge of murder. After counsel for the State had given certain information to the trial B Judge, the latter decided that it was unlikely that the death sentence would be imposed, and decided not to appoint assessors. The trial, however, took an unforeseen turn when the appellant adopted a different defence to that which the State had expected. The Court found that there were no extenuating circumstances and accordingly imposed the death penalty. The trial Judge granted leave to appeal against the finding and raised the question whether the fact that he had not had the benefit of being able to consult with nor have the opinions of assessors C was not a factor which might influence the Court on appeal in deciding whether there were indeed extenuating circumstances. The Court on appeal found that in the circumstances no irregularity had been committed. The conviction of murder without extenuating circumstances was confirmed and the appeal was dismissed. D

Nadat die advokaat wat namens appellant opgetree het sy argument voltooi het, het die Hof die appèl afgewys met 'n aanduiding dat redes later ingehandig sal word. Die volgende is die redes.

A aan moord sonder versagtende omstandighede en is ter dood veroordeel. Hy is ook skuldig bevind op 'n aanklag dat hy na sy arrestasie uit bewaring ontsnap het maar vir huidige doeleindes is dit nie ter sake nie. Met verlof van die Verhoorregter kom appellant nou in hoër beroep slegs teen die bevinding dat, vir sover dit sy skuldigbevinding aan moord betref, daar geen versagtende omstandighede teenwoordig was nie en B die verpligte doodstraf wat daarop gevolg het.

Voordat ek daartoe oorgaan om die feite van die saak te bespreek, moet ek noem dat die Verhoorregter in die onderhawige geval besluit het om nie assessore by te roep om hom by te staan nie en die verhoor het dus plaasgevind sonder assessore. Hieroor sê die Verhoorregter die volgende in sy uitspraak of versagtende omstandighede teenwoordig is al dan nie: C

'Voor die verhoor begin het, was dit my plig om te besluit of ek assessore moes byroep om my by te staan of nie. Vir daardie doel, omdat ek niks van die saak geweet het nie, het ek - soos altyd die geval is - die Staat se advokaat gevra of dit nodig is om assessore by te roep en as gevolg van wat hy my meegedeel het, was ek desryds van mening dat D dit onwaarskynlik was dat die doodvonnis opgelê sou word. Gevolglik het ek nie assessore bygeroep om my by te staan nie.'
