Appellant, wat deur 'n Regter en assessore aan moord skuldig bevind is, het van hierdie Hof verlof ontvang om te appelleer teen die bevinding van die Verhoorhof dat daar by die pleeg van die misdaad geen versagtende omstandighede aanwesig was nie.

Die notule van die saak toon dat appellant in die vroeë oggendure van 9 Desember 1962 'n Bantoeman met 'n mes doodgesteek het. Appellant het G getuienis afgelê en te kenne gegee dat hy die nag voor die moord op 'n dans van stamgenote was waar hy saam met ander gedrink het. 'n Staatsgetuie, Gibaziwela, wat die aanranding op die oorledene gesien het, het verklaar dat appellant dronk was en gewaggel

het. Die getuie het ook gesê, 'terwyl hy inkom, toe sê ek die man is dronk maar toe hy praat sien ons die man het nie gedrink nie'. 'n Ander Staatsgetuie, Zimula, 'n mynkonstabel, wat appellant kort na die aanranding gesien het, het onder kruisverhoor erken dat hy in sy A getuienis by die voorlopige verhoor gesê het dat appellant dronk was. Hy het ook verder gesê dat hy onthou dat appellant geslinger het en soos 'n dronkmens gepraat het. 'n Bantoe-speurdersersant van die polisie, Moromula, het appellant later dieselfde oggend gesien en gesê dat hy van mening was dat appellant die vorige dag baie gedrink het maar toe hy met B appellant gepraat het, laasgenoemde nie dronk gelyk het nie. Nadat appellant skuldig bevind is aan moord het die Verhoorhof die vraag oorweeg of versagtende omstandighede aanwesig was en volgens die uitspraak tot die volgende...
