This case comes before us on a question of law reserved in this form - namely whether there is any legal evidence upon which the Court was entitled to convict the accused on either count, that is of falsity or alternatively theft. The case lasted four or five days in the court below and, as the learned Judge said, the case was well conducted: the arguments were ably advanced on both sides and covered all the matters in dispute. The learned Judge considered all the points raised including Mr. Hanson's searching criticism of the evidence of Ellison and Nathan. He concluded that the evidence of one of the admitted criminals, that of Nathan, was in the main correct and that he was corroborated by Ellison and confirmed by the surrounding circumstance.
