PREFACE / VOORWOORD

In 1973 het die 23-jarige Gerhard Lubbe as senior lektor by die Stellenbosse

Regsfakulteit aangesluit; drie jaar later is hy tot professor bevorder, 'n posisie

wat hy vir bykans vier dekades, tot sy aftrede aan die einde van 2014, beklee

het. Gerhard is 'n beskeie, privaat mens, en sou beslis verkies dat geen ophef

gemaak word van wat hy in hierdie merkwaardige loopbaan vermag het nie.

Maar konvensie en, nog meer belangrik, die agting en deernis wat soveel van

ons as vriende en kollegas vir horn as akademikus en persoon het, maak dit

onmoontlik om aan so 'n sentiment gehoor to gee.

The purpose of this special edition of the

Stellenbosch Law Review is

to

honour Gerhard Lubbe by way of a collection of essays in fields of law in which

he made his mark. The authors engage with important themes in the general

law of contract, such as fairness and good faith, requirements of form, legality,

breach of contract and the resultant remedies, as well as the termination and

transfer of obligations. Like the

Jubilar,

the contributors further consider

topics that are of broader significance in private law, for example the operation

of overarching instruments like estoppel, and the interaction between contract

and the disciplines of arbitration, property, delict and unjustified enrichment.

Although many authors naturally refer to Lubbe's work, the aim has not been

to provide a comprehensive assessment of his legacy. However, my colleague

Franziska Myburgh and I have sought below to provide readers with a broad

overview of some of the characteristics of his method, and the main fields in

which he applied it in such a unique and compelling manner.

This collection also does not seek to sketch a biographical picture of Gerhard

Lubbe, an endeavour which, given his reserved nature, would have been rather

challenging. However, it was impossible to resist the temptation to include

at least a few introductory personal perspectives by friends, colleagues and

former students in the preface below, and in this way provide the reader with

some insights into the remarkable person we are honouring here.
