Met aankoms op d ie Hosea Kutako Inter nasionale Lughawe in Wind hoek, Namibië verskaf t wee senior
advokate van die Joha nnesburg balie vals inl igting aan die immig rasiepersoneel van die buu rland oor
die rede vir hul b esoek aan die land. Die eerste ap pellant het aangedui dat hy die la nd wil binnekom
vir ’n besoek, terw yl die tweede appellant aan gedui het dat hy ’n vergadering kom bywoon. Beide se
oogmerk was egt er om Namibiese kliënte in ’n borga ansoek in die landdr oshof te verteenwoordig. Op
grond van hul med edelings is besoekerspe rmitte aan beide uitge reik. Beide appellante is die volgend e
dag by die landd roshof waar hulle namens k liënte wou verskyn, gea rresteer.
Met hul versky ning laat dieselfde Vr ydagmiddag in d ie Windhoek landd roshof, pleit beide appellant e
skuldig op twee a anklagte van oor treding van artikel s 29(5) en 54(e) van die Namibiese Immig ration
Control Act 7 van 1993. Beide word na behore deur die landdros ondervra ingevolge artikel 112(1)
(b) van die Strafproseswet 51 van 1977 en ná skuldigbevi nding gevonnis tot betali ng van boetes met
gevangenisst raf as alternatief.
Die appellante appelleer teen die skuldigbevindings en vonnisse na die Namibiese hoë hof en ná
afwysing van die appèl, na die hooggeregshof. Die eerste grond van appèl handel oor die interpretasie
van arti kel 29(5) van die Immigration Control Act. D ie appellante voer aan da t ’n enkele verskyning in
’n borgaansoek nie a angemerk kan word as die bed ryf van ’n professie as advokaat soos b edoel in die
immigra siewetgewing nie. As sodanig sou n a bewering ’n besoekersper mit voldoende wees en sou ’n
werkperm it nie vereis word om die lan d binne te kom om in slegs ’n en kele saak te versk yn nie. As tweed e
grond is aangevoer dat beide appellante in besit was van ’n sertik aat uitgerei k deur die Namibiese
hoofregter waarin toestemming ingevolge artikel 85(2) van die Legal Practitioners Act 15 van 1995
verleen is vir hul ve rskyning in die Namibie se hof. Die appellante versoek dat die sk uldigbevindings
