Die beskuldigdes is in 'n streekhof aangekla van vier klagtes van diefstal. Dit het geblyk dat die Staat sou steun op 'n gemeenskaplike doel, en die verdediging het nadere besonderhede versoek, onde andere aangaande die 'terme' van die beweerde gemeenskaplike doel. Nadere besonderhede, waarin dit beveestig is dat die Staat sou steun op 'n E gemeenskaplike doel, is verskaf, maar die terme daarvan is onvermeld gelaat. Aansoek ingevolge art 87 van die Strafproseswet 51 van 1977 is toe voor die streekhof gedoen om die Prokureur-generaal (die tweede respondent) te verplig om die aangevraagde besonderhede te verskaf. Die streeklanddros het bevind dat die versoek om besonderhede alles inaggenome tóg voldoende beantwoord is. Die beskuldigdes was nie met die bevinding F tevrede nie en het hulle na die Provinsiale Afdeling gewend vir die regstelling van die streeklanddros se bevel. Die vraag wat ontstaan het was of die Hof kon inmeng met die bevinding van die streekhof betreffende die nadere besonderhede voordat die verrigtinge voor daardie hof gefinaliseer is.
Beslis, dat, alhoewel die beskuldigdes moontlik nie volledig ingelig was G aangaande al die terme van die gemeenskaplike doen nie, die klagstate soos aangevul deur die verskafte besonderhede tog genoegsame inligting bevat het om die beskuldigdes in staat te stel om hul verdediging voor te berei.
Beslis, derhalwe, dat die versuim van die Staatsaanklaer om die terme van die gemeenskaplike doel te verskaf nie neergekom het op so 'n growwe H onreëlmatigheid of onregverdigheid teenoor die beskuldigdes dat ingryping in die ongefinaliseerde verrigtinge van die streekhof geregverdig is nie, en dat die aansoek afgewys moes word.

A supplemented by furnished particulars provided sufficient information to enable accused to preparee their defence — failure of prosecutor to furnish further particulars accordingly not constituting such gross irregularity or grave injustice vis-à-vis accused that intervention in unfinalised proceedings in court below justified.

B The accused had been charged in a regional court with four counts of theft. It had appeared that the State intended to rely on common purpose, and the defence had requested further particulars, inter alia regarding the 'terms' of the alleged common purpose. Further particulars, in which it was confirmed that the State would rely on common purpose, were furnished, but the terms thereof were not disclosed. An application in terms of s 87 of the Criminal Procedure Act 51 of 1977 was launched by the C accused in order to compel the Attorney-General (the second respondent) to supply the requested particulars. The regional magistrate held that the request for futher particulars had been, all things considered, adequately complied with. The accused were not satisfied with this decision and approached the Supreme Court for the correction of the regional magistrate's order. The issue before the Court was whether it could D interfere with the decision of the regional court regarding the further particulars before the proceedings there had been finalised.
