I do not think that this surrender should be accepted. The only asset in the estate is immovable property which has been sold to the applicant's son-in-law. The applicant brings up this asset in his schedules at a figure of £2,100 and shows debts secured by bonds on the property to the value of £1,890; he claims that the balance of £220 would be available for distribution amongst creditors. I do not propose to say anything on the merits or demerits of what the applicant proposes, but it seems to me that it is very doubtful that the sum of money amounting to £220, which he says would thus become available for distribution amongst his creditors, ever would become available. The purchaser - who is the intervening creditor, Naude - says that he bought this property in 1947 for the sum of £1,925 and that the amount owing on the bonds on the property to-day is £1,881, leaving less than £45 excess. Mr. Merber has argued that the property must be worth more than the bonds, but I can see no reason for saying that it must be worth more than the bonds. I have the fact that the property was bought for £1,925 and that is bonded for £1,881.
