A Joubert AR:
Hierdie is 'n appèl teen die afwysing deur Kirk-Cohen R van die appellant se aansoek in die Witwatersrandse Plaaslike Afdeling. Met verlof van die Hof a quo kom die appellant tans in hoër beroep na hierdie Hof.
Die feite in hierdie aangeleentheid is eenvoudig en onbetwis. Die B appellant, 'n eiendomsontwikkelaar van beroep, is die eienaar van erf 668, Ferndale, Randburg, wat vir gebruik as 'residensieel 1' gesoneer was. Die respondent ('die Stadsraad van Randburg') het op 3 Mei 1989 ooreenkomstig die bepalings van art 57(1) van die Ordonnansie op Dorpsbeplanning en Dorpe 15 van 1986 (T) in die Provinsiale Koerant kennis gegee van sy C goedkeuring van die Randburg-Wysigingskema 1286 waarvolgens erf 668 hersoneer is vanaf residensieel 1 na residensieel 4 onderhewig aan sekere voorwaardes. Volgens art 58(1)(b) is die datum van die inwerkingtreding van die goedgekeurde Randburg-Wysigingskema 1286 die datum van die publikasie van die goedkeuring daarvan in die Provinsiale Koerant, dws 3 Mei 1989.
D Die Stadsraad van Randburg het ingevolge art 63(1) 'n geregistreerde brief, gedateer 25 Mei 1989 wat egter eers op 2 Junie 1989 versend is, aan die appellant gerig. Dit blyk egter nie uit die stukke voor die Hof wanneer die appellant dit inderdaad ontvang het nie. In hierdie skrywe is die appellant meegedeel om 'n bydrae van R80 113,27 ten opsigte van E ingenieursdienste aan die Stadsraad van Randburg te betaal 'soos en wanneer dit betaalbaar is'. Besonderhede van hoe hierdie bedrag saamgestel is asook die doel waarvoor dit vereis word, is verstrek. Bylaes is aangeheg om die besonderhede van die berekenings van die bydrae asook die doel waarvoor die bydrae vereis word, aan te toon.
F Dit is gerieflik om op hierdie stadium die bepalings van art 63(1) en (2) aan te haal, nl:
'63(1) Waar 'n wysigingskema wat 'n goedgekeurde skema is ingevolge art 58(1) in werking getree het, kan die gemagtigde plaaslike bestuur die eienaar van grond waarop die skema betrekking het binne 'n tydperk van 30 dae vanaf die datum van die inwerkingtreding van die skema per G geregistreerde brief gelas om 'n bydrae aan hom ten opsigte van die voorsiening van -
die ingenieursdienste in hoofstuk V beoog, te betaal, waar dit nodig sal wees om sodanige dienste uit te brei of te verbeter as gevolg van die inwerkingtreding van die wysigingskema;
oop ruimtes of parke te betaal waar die inwerkingtreding van die wysigingskema 'n hoër residensiële digtheid sal meebring,
H en hy meld in daardie brief -
die bedrag van die bydrae;
besonderhede van die wyse waarop die bedrag van die bydrae behaal (bepaal) is; en
die doel waarvoor die bydrae vereis word:
