Botha en 'n Ander v Marais

Ogilvie Thompson, H.R.:

Die appellante kom in hoër beroep teen 'n bevel van die Oranje-Vrystaatse Provinsiale Afdeling waarby hulle elkeen gelas word om, weens laster, skadevergoeding ten bedrae van R750, tesame met koste van geding, aan die respondent te betaal.

Op 13de April 1970, gedurende die algemene E Volksraadsverkiesingsveldtog van daardie jaar, het eerste appellant - wat te alle tersaaklike tye die amp van Minister van Waterwese in die huidige Regering van die Republiek beklee het - 'n openbare vergadering te Shannon, naby Bloemfontein, toegespreek. In die loop van sy toespraak het eerste appellant na die Herstigte Nasionale Party en respondent - destyds, asook ten tyde van die verhoor, die onderleier van daardie F party - verwys. Die volgende dag het die Volksblad - 'n nuusblad wat in Bloemfontein en elders sirkuleer, en waarvan tweede appellant die eienaar, drukker en verspreider is - 'n berig oor eerste appellant se toespraak gepubliseer. Die opskrif en, wat hierdie appèl betref, tersaaklike dele van daardie berig (d.w.s. die eerste drie paragrawe daarvan) lui soos volg:

"'J. Marais deur rooi idees gebreinspoel'.

G Mnr. Jaap Marais van die Hertzog-groep is 'n gebreinspoelde mens, het mnr. S. P. Botha, Minister van Waterwese, gisteraand op 'n vergadering van die N.P. op Shannon gesê.

Mnr. Marais is gebreinspoel toe hy soveel gelees het oor die kommunisme. Dieselfde taktieke wat die kommunisme aanwend, word nou deur die groep gebruik.

Tipiese metodes wat hulle aanwend wat ooreenstem met die H kommunistiese gedrag, is die aftakeling van die volksleiers, die gesmous met dit wat heilig is vir 'n volk, en so voorts."

Dit is gemene saak dat "J. Marais" die respondent is en dat die "Hert-zog-groep" hier genoem 'n verwysing na die Herstigte Nasionale Party is, en dat dit so deur die gehoor te Shannon, asook deur die lesers van die Volksblad, verstaan sou word. Die berig is deur ene Mostert, 'n verslaggewer op die personeel van tweede appellant en wat genoemde vergadering bygewoon het, geskryf. In die Hof benede is Mostert as getuie namens eiser (die huidige respondent) geroep. Mostert het getuig dat

eerste appellant se toespraak oor watersake en politiek gegaan het. Eerste appellant het wel na respondent se politieke bedrywighede verwys, maar tegelyk dit positief gestel dat respondent nie 'n kommunis is nie. Mostert het verder getuig dat hy aantekeninge, asook 'n bandopname, van eerste appellant A se toespraak gemaak het en, verder, dat sy bogemelde berig geskryf is kort na die voltooiing van die toespraak en nadat hy sy aantekeninge geraadpleeg en die bandopname teruggespeel het. Ten tyde van die verhoor was die aantekeninge en die bandopname reeds vernietig.

Eerste appellant het nie self in die Verhoorhof getuienis B afgelê nie, en die enigste getuienis voor ons t.o.v. wat hy gedurende sy toespraak aangaande respondent sou gesê het, is dié van Mostert. Onder die omstandighede moet aanvaar word dat die hierbo-aangehaalde berig 'n juiste weergawe bevat van die relevante woorde deur eerste appellant gebesig. Respondent se vordering is inderdaad uitsluitlik daarop gefundeer. Dit dien C ook verder genoem te word dat respondent se besonderhede van vordering geen innuendo of bewering van 'n sekondêre betekenis bevat nie. Ek kan verder daarvan melding maak dat in Mostert se getuienis ten opsigte van eerste appellant se toespraak daar niks is wat daarop dui dat die gewraakte woorde enige spesiale betekenis vir die toehoorders te Shannon kon ingehou het nie. D Ook die berig in die Volksblad bevat klaarblyklik geen sodanige aanduiding nie.
