Respondent het op 20 September 1994 'n aksie ingestel in die Kaapse landdroshof teen Minas Minassian handeldrywend as 'Rolo Bakery' (hierna Minassian genoem) vir betaling van die bedrag van R198 590,84 wat na bewering aan respondent verskuldig was ingevolge 'n huurooreenkoms waarkragtens Minassian sekere toerusting van respondent gehuur het. Op 5 Oktober 1994 het respondent vonnis geneem teen Minassian vir betaling van die bedrag van R115 359,80. H Respondent het dieselfde dag 'n lasbrief vir eksekusie laat uitreik. Ter uitvoering van die lasbrief het die balju op 11 Oktober 1994 beslag gelê op sekere toerusting van Minassian.

As gevolg van 'n aanspraak wat appellant op die toerusting gemaak het, is 'n tussenpleitgeding in die landdroshof aanhangig gemaak. In terme van die I tussenpleitdagvaarding wat op 22 Februarie 1995 uitgereik is, is respondent as eksekusieskuldeiser en appellant as aanspraakmaker opgeroep om appellant se aanspraak ten opsigte van die toerusting waarop beslag gelê is en wat in bylae 'A' tot die dagvaarding beskryf is, te laat beslis. A Appellant het 'n beëdigde verklaring in terme van Reël 44(2)(c) ingedien waarin Wesley Horstmann, appellant se verkoopbestuurder, appellant se aanspraak as eienaar van die toerusting gemotiveer het. Die aanspraak berus daarop dat appellant die goedere by Minassian gekoop het en as gevolg daarvan eiendomsreg daarin verkry het. Horstmann beweer verder dat hy en appellant onbewus was daarvan dat daar 'n B spesiale notariële verband ten gunste van respondent oor die toerusting geregistreer was.

Dit blyk uit appellant se beëdigde verklaring dat appellant aanvaar het dat respondent se aanspraak op die toerusting nie net op sy regte as eksekusieskuldeiser berus het nie, C maar ook op sy regte uit hoofde van die spesiale notariële verband. Die verdere verrigtinge is dan ook op daardie basis gevoer.

Die spesiale notariële verband is op 26 Mei 1993 in die Aktekantoor geregistreer. In terme daarvan gee Minassian voor om bepaalde toerusting wat daarin omskryf word, ten gunste van respondent te verbind. Dit sluit al die toerusting in waarop die balju D beslag gelê het en wat in bylae 'A' tot die dagvaarding beskryf is.

Die tussenpleitgeding is na verhoor verwys. Appellant het 'n aantal getuies geroep om sy aanspraak op eiendomsreg te bewys. Respondent het geen getuies geroep nie.

Die landdros het appellant se aanspraak van die hand gewys op grond daarvan dat dit E nie behoorlik bewys gelewer het van die feit dat dit die eienaar van die betrokke toerusting was nie.

Appellant kom nou in hoër beroep teen die landdros se uitspraak.

Dit is appellant se saak, in kort:

(a)

dat die betrokke toerusting, tesame met sekere ander items, aanvanklik die F eiendom van United Bank Bpk was wat dit aan Minassian verkoop het kragtens 'n afbetalingsverkoopooreenkoms;

(b)

dat United Bank Bpk op 29 September 1993 ten volle betaal is vir die verkoopte goed as gevolg waarvan die eiendomsreg daarin op Minassian G oorgegaan het;

(c)

dat appellant die toerusting (tesame met die ander items) op 28 September...
